Bitcoin ETF rejections: how the SEC got from no to yes

The SEC turned down every spot Bitcoin ETF proposal it ruled on from 2017 to 2022, then approved eleven at once in January 2024 after losing a court case to Grayscale. The table lists the key orders.

Why the SEC said no. In each rejection, the SEC said the exchange had not shown that the fund’s bitcoin pricing was protected from fraud and manipulation, mainly through surveillance-sharing with a regulated market of significant size. The D.C. Circuit found in August 2023 that the SEC had not explained why it treated Grayscale’s spot fund differently from the bitcoin futures funds it had already allowed. Five months later the SEC approved the spot funds.

What changed since. Leveraged funds arrived through futures first: Volatility Shares’ 2x Bitcoin fund, BITX, launched on June 27, 2023. The October 2, 2026 order raises the maximum leverage on a US Bitcoin ETF from 2x to 3x.

What last week’s flows mean for ETF holders

  • Flows don’t change what a share holds. A spot Bitcoin ETF share still tracks bitcoin’s price minus the fee, whether the fund had inflows or outflows that day.
  • One fund can drive a whole week. FBTC accounted for 56% of the net Bitcoin ETF outflows from October 5 to October 9, 2026, while IBIT was flat.
  • A 3x fund resets every day. Its long-term return depends on the path of the price, not only where bitcoin ends up, so it behaves differently from a spot fund held for months.

How we build this page

Daily flows come from Farside Investors, which compiles them from issuer disclosures; we add them up with code and count only days with complete data. Regulatory items are linked to the SEC order or filing on sec.gov, and news from other outlets is named with its source and date. Holdings come from Bitbo and our spot Bitcoin ETF tracker. We update the page every Friday and change the “Last updated” date when a figure moves.
